Decree on the symbols of local entities in the Balearic Islands

The procedure of adoption, modification or rehabilitation of flag and arms by the local entities in the Balearic Islands is prescribed by Decree No. 7, issued on 11 February 1988 by the Government of the Balearic Islands and published on 25 February 1988 in the official gazette of the Autonomous Community of the Balearic Islands, No. 24, pp. 852-853 (text), as follows.

Article 1.
The local entities of the Balearic Islands can adopt a coat of arms, a flag, a blazon, a motto and a title, modify those symbols already recognized and rehabilitate their historical symbols, in compliance with the procedure described in this Decree.

Article 2.
The Municipal Council is in charge of the adoption of agreements relative to the adoption, modification or rehabilitation of a flag, standard or coat of arms, in compliance with Article 22.2.b) of Law No. 7 of 2 April 1985 regulating the bases of local regime.

Article 3.
The files to be presented shall contain the following items:
a) A memoir explaining the rationale backing the proposal of approval, modification or rehabilitation of the flag or coat of arms. Also all documents and studies deemed worth of interest.
b) A sketch of the proposal.
c) A copy certified by the Secretary of the municipality of the Agreement adopted by the Municipal Council on the adoption, modification or rehabilitation of the flag or arms.
d) The outcome of the public information on the Agreement made available for no less than 15 days.

Article 4.
The files shall be forwarded to the Directorate General of the Territorial Administration of the Council Adjunct to the Presidency.

Article 5.
The Directorate General of the Territorial Administration, once the files received, shall request a recommendation the Royal Academy of History within 10 days.
The recommendation shall be supplied within two months. The lack of reception of the recommendation in due time shall not postpone the procedure.

Article 6.
If the recommendation described in the preceding Article is not favorable to the proposal submitted by the local entity, the local entity shall be forwarded the recommendation and shall express its agreement or disagreement within one month.

Article 8.
The Agreement adopted by the Council of Government shall be notified to the local entity and published in the official gazette of the Autonomous Community of the Balearic Island and in the Spanish gazette.
